1. ACCEPTANCE OF TERMS

By accessing, browsing, or purchasing from Garrett Lure Company, you (the "Customer") agree to be bound by these Terms and Conditions.

2. HANDMADE PRODUCT ACKNOWLEDGMENT

Garrett Lure Company takes pride in offering premium fishing lures. The Customer explicitly acknowledges and agrees that all products sold by Garrett Lure Company are 100% handmade. Because our lures are not mass-produced by automated machinery, they possess unique characteristics inherent to handmade items.

3. PRODUCT VARIATION AND DEVIANCE

By executing a purchase, the Customer accepts that natural and expected variations will occur. The Customer understands and agrees to the following regarding product deviance:

  • Individual Variation: No two lures will be exactly the same. Slight variations in weight, paint patterns, coloration, texture, and size are a natural result of the handmade process.

  • Batch Variation: There may be noticeable variances in cosmetic appearance and material finish from one production batch to another.

  • Representation: While we strive to ensure product photography accurately represents our lures, the physical product received may differ slightly from the digital representation on our website due to the aforementioned handmade variations.

4. REFUND WAIVER AND EXCEPTIONS

Due to the inherently unique nature of our handmade products, the Customer hereby expressly waives their right to a refund, return, or exchange based on any variation, deviance, or cosmetic discrepancy between the received product and the general product description or photography.

4.1 EXCEPTION TO WAIVER (CUSTOM REQUESTS)

The sole and exclusive exception to the aforementioned refund waiver shall be granted only if all of the following conditions are met:

  1. The Customer submits a formal, written "Custom Request Form" to Garrett Lure Company prior to the execution of the purchase.

  2. The Custom Request Form expressly outlines the strict parameters or specific tolerances required by the Customer.

  3. Garrett Lure Company explicitly approves the Custom Request Form in writing.

  4. The approved Custom Request Form is tied directly and explicitly to the final Order Number of the purchased lure(s).

If a lure associated with an approved Custom Request Form significantly deviates from the mutually agreed-upon written parameters tied to that specific Order Number, the Customer may be eligible for a refund or replacement at the sole discretion of Garrett Lure Company.

5. LIMITATION OF LIABILITY

Garrett Lure Company shall not be held liable for any direct, indirect, incidental, or consequential damages arising out of the use or inability to use our products, including but not limited to lost fishing opportunities, equipment damage, property damage, or personal injury. All products are used entirely at the Customer's own risk.

6. MODIFICATIONS TO TERMS

Garrett Lure Company reserves the right to update, modify, or replace any part of these Terms and Conditions at our sole discretion. It is the Customer's responsibility to check our website periodically for changes. Continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

7. GOVERNING LAW

These Terms and Conditions and any separate agreements whereby we provide you products shall be governed by and construed in accordance with the laws of the State in which Garrett Lure Company is headquartered, without regard to its conflict of law provisions.
